TERMS AND CONDITIONS

 

1. Participating in this ‘CBSA Technical Consultancy Fund offer (Promotion) is deemed acceptance of these terms. Information explaining how to participate is part of these terms. Participation is invalid in conjunction with the Promoter’s other offers.

2. This Promotion starts on 5 June 2024 and ends 31 December 2024.

Eligibility

3. This Promotion is open to registered attendees (Eligible Participants) are Australian businesses with a valid ABN registered for GST during the Promotion Period who are not existing cloud services customers of Canon Business Services Australia or its affiliates.

4. To participate in the Promotion, Eligible Participants must sign by 31 December 2024 a managed services contract with CBSA for the Eligible Services.

5. ‘Eligible Services' means any Cloud Managed Services offered by CBSA with a (i) minimum monthly value of $5000 a month; and (ii) minimum service term of at least 36 months.

Promotion Offer

6. Eligible Participants who purchase Eligible Services during the Promotion Period will receive an allowance (Technical Consultancy Fund Allowance) which can be applied to any future consultancy or professional services provided by the Promoter:

7. The Technical Consultancy Fund Allowance is calculated based on the initial monthly Cloud services fee set out in the Services Schedule at the time of signing;

8. The Technical Consultancy Fund Allowance:

a. must be used within the first 12 months from the commencement of Eligible Services;

b. applies to the professional services or consultancy services only (such as costs of migration, cover design, architectural consultancy); and

c. cannot be applied to any monthly consumption, hardware, licensing or subscription costs or third-party costs involved in the provision of any managed services.

9. Unused amounts after the 12 months will be forfeited and cannot be extended.

10. Credits cannot be redeemed for cash.

11. The Eligible Participant agrees the Promotion is not valid on any other CBSA services except the Eligible Services.

Promoters Decision

12. The Promoter’s decision is final and binding and no correspondence will be entered into.

13. If this Promotion is interfered with in any way or is incapable of being conducted as reasonably anticipated for any reason, including technical difficulties, unauthorised intervention or fraud, the Promoter may, in its sole discretion and to the extent the law permits

a. disqualify any Eligible Participant; or

b. modify, suspend or cancel the Promotion.

14. The Promoter may accept errors and omissions at its discretion and its failure to enforce any of its rights does not constitute a waiver of them.

Collection of Personal Information

15. The Promoter collects personal information in connection with this promotion to conduct the promotion. The Promoter may, for the purpose of conducting this promotion, disclose such information to third parties, including agents, contractors, service providers, suppliers and, as required, to regulatory agencies. Participation is conditional on providing this information.

16. Personal information collected by the Promoter in connection with this promotion will be managed in accordance with its Privacy Policy (available at https://business.canon.com.au/privacy), which contains information about access, correction and complaint processes.

General

17. Eligible Participants may have legal rights, including consumer guarantees under Australian Consumer Law that may not be excluded or limited under law. Subject to this, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) whether direct, indirect, special or consequential for any loss or damage arising in connection with this Promotion including any:

a. technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

b. theft, unauthorised access or third party interference;

c. Promotion claims that are late, lost, altered, damaged or misdirected (whether or not after the Promoter receipts it) due to any reason beyond the Promoter’s reasonable control;

d. tax liability incurred by an Eligible Participant; or

e. the Eligible Participant’s use of the Eligible Products.

18. These terms are governed by the laws of New South Wales and the parties submit to the non-exclusive jurisdiction of its courts.
